“It’s not the will to win that matters– everyone has that. It is the will to prepare to win that matters.” – Paul “Bear” Bryant

Professional Overview: Scott Holmes is a Managing Partner at Burgess Holmes and an AV Preeminent–rated trial lawyer practicing across Alabama and Mississippi. He defends complex civil litigation with the judgment to resolve cases efficiently and the trial experience to try the ones that demand it. Drawing on an earlier career as a high school football and basketball coach, Scott brings a preparation-first discipline to every file: the cases are won in the work that happens before trial.

Legal Education and Distinctions: A graduate with Honors from the University of Alabama School of Law, Scott was recognized as a Hugo Black Scholar, one of the law school’s highest academic distinctions. His leadership roles included serving as Senior Editor of the Alabama Law Review, Assistant Prosecutor for the UA Honor Court, and Lieutenant Governor for the American Bar Association’s Fifth Circuit. He was also Vice-President of Phi Delta Phi Legal Fraternity and a member of the Bench and Bar Legal Honor Society.

Scott’s practice spans the full spectrum of civil litigation, with particular emphasis on construction and design professional defense, trucking and transportation, professional liability, and catastrophic injury. Representative results include:

  • Secured summary judgment for a public utility in a complex environmental-contamination suit in Walker County, exiting the client on the merits before a four-week trial in which the jury returned a $70 million verdict against the remaining co-defendants — among the largest in the county’s history
  • Won summary judgment on all claims for a precast concrete foundation manufacturer in a Marshall County construction-defect case seeking more than $680,000, securing dismissal on privity, caveat emptor, and the absence of legally cognizable damages
  • Obtained dismissal of a Blount County personal-injury claim for failure to prosecute, a result made final by the expiration of Alabama’s statute of limitations
  • Obtained a defense jury verdict in a wrongful-death case arising out of the trucking industry
  • Secured summary judgment in multiple catastrophic-injury matters, including construction and workplace accidents, and obtained favorable outcomes in binding arbitration for construction professionals
